Hasty Pope Partner Jonathan Pope recovered $350,000.00 for a Cherokee County, Georgia pedestrian struck by a vehicle in the parking lot of the Cracker Barrel in Canton, Georgia. The client had finished dinner with his wife and was walking to his vehicle in the parking lot of the Cracker Barrel at around 7:30 p.m. when he was struck by a motorist driving a Ford F150. The client was treated for left shoulder and neck pain and various cuts and bruises at the scene and was later seen at the emergency room at Northside Hospital-Cherokee. The client then followed up with an orthopedic surgeon for left shoulder and neck pain. He ultimately underwent surgery on his left shoulder with a good recovery. The client was also referred for neck surgery but had decided not to have surgery.
The motorist who struck the client denied all responsibility for the incident. As a result, a lawsuit was filed in Cherokee County State Court. The defendant driver claimed our client was at fault because it was dark and our client was wearing all black and should have seen the defendant’s vehicle. Jon and his team investigated all aspects of the incident. This included obtaining video surveillance from Cracker Barrel showing the incident. A key part of the investigation involved Jon obtaining the defendant’s prior medical history. The defendant initially objected to turning over his prior medical history but Jon and his team never gave in. Once Jon obtained it, the defendant’s prior medical history showed the defendant had complained of severe vision problems – blurry vision and trouble seeing at night - just four months before the incident. The records revealed the defendant had suffered from serious vision issues for years before the incident. When presented with this information and a claim for punitive damages, the insurance company agreed to settle the case.
