"We Both Have the Same Insurance Company." Is That a Problem?

It is one of the more surprising phone calls we receive at Hasty Pope.

A client will tell us they were injured in a car accident, explain what happened, and then pause before asking a question that has clearly been weighing on their mind.

"I just found out we both have State Farm. Does that mean I have a problem?"

It's a fair question.

Most people assume that if both drivers are insured by the same company, the insurance company can't fairly handle both claims—or worse, that they won't be able to recover the compensation they deserve.

After decades of representing injured people throughout North Georgia, we can tell you the answer is usually much simpler.

No. Having the same insurance company does not prevent you from pursuing your claim.

But it does make understanding your rights even more important.

A Conversation We've Had Many Times

This isn't a hypothetical situation.

Over the years, Tom and Jon Pope have represented clients who were surprised to learn that both vehicles involved in the crash were insured by the same company.

The immediate concern is almost always the same.

"How can one insurance company represent both sides?"

The answer is that the insurance company is handling different policies that provide different types of coverage.

One policy belongs to the at-fault driver.

The other belongs to you.

Those are separate obligations, even if they happen to be issued by the same insurer.

Understanding the Two Types of Coverage

In many Georgia car accident cases, the at-fault driver's liability insurance is the first source of recovery.

That policy exists to compensate people who were injured because of the driver's negligence.

Depending on the circumstances and your own insurance policy, you may also have access to your own underinsured motorist (UM/UIM) coverage if your damages exceed the available liability limits.

Many people don't realize they have this protection until after an accident.

Even fewer understand how valuable it can become when injuries are serious.

The Insurance Company Is Still Evaluating Your Claim

People often assume that because the insurance company insures both drivers, the claim will somehow be easier.

That isn't always the reality.

Regardless of which policy is involved, the insurance company is still evaluating the claim, reviewing the evidence, and determining what it believes it owes under the terms of each policy.

That's one reason why having experienced legal counsel can be so important.

Our role is not to make the process more complicated.

Our role is to make sure every available source of recovery is identified, every piece of evidence is preserved, and every aspect of your injury is fully documented before important decisions are made.

Every Case Starts With Questions

One thing we've learned after decades of handling injury cases is that no two accidents are exactly alike.

When someone hires Hasty Pope, we don't assume the insurance situation is straightforward simply because both drivers have the same company.

Instead, we begin asking questions.

What insurance policies are available?

What are the liability limits?

Is underinsured motorist coverage available?

Are there additional policies that may apply?

Has every source of compensation been identified?

Those answers can significantly affect the outcome of a case.

Experience Matters When Insurance Gets Complicated

Insurance policies can be confusing, especially after a serious accident.

We've had countless conversations with clients who assumed they understood their coverage, only to discover there were important questions that still needed answers.

Sometimes it's about identifying additional coverage.

Sometimes it's about understanding how different policies interact.

Sometimes it's simply helping a client understand that having the same insurance company doesn't automatically put them at a disadvantage.

Every case deserves that careful review.

The Goal Is the Same

Whether the drivers have different insurance companies or the exact same one, our goal never changes.

Protect our client's future.

That means preserving evidence, understanding the full extent of the injuries, identifying every available insurance policy, and pursuing the compensation our client is entitled to under the law.

The name on the insurance card doesn't change our approach.

Don't Assume. Ask.

If you've been injured in a car accident and discovered that both drivers have the same insurance company, don't assume you know how your claim will work.

Ask questions.

Understand your coverage.

Learn what options may be available before making decisions about your case.

At Hasty Pope, those conversations happen every day.

We're here to explain the process, answer your questions, and help you understand your rights so you can focus on what matters most: your recovery.
